Most probate situations can be handled by the same person who is acting as the Personal Representative of the Estate if the heir pretty much agree how the property in the estate is to be divided. If there is a Will most of the time the division of property is laid out there. Your specific situation can be analyzed to determine, however, if potential issues exists that can be identified that may pose problems for an unrepresented individual Personal Representative.

Also, other probate type matters that do not necessarily need a Court to be involved. Durable Powers of Attorney allow the individual who acts to act on someone’s behalf, regarding financial issues. Those can be used to act on someone’s behalf if they are competent to sign the same. Also, medical Powers of Attorney will allow someone to make medical decisions for another if that person is unable to act, due to injury, during and after a medical procedure or if that person later becomes incapacitated.
